Terms & Conditions

Please read these terms carefully before booking with us

These Terms & Conditions govern all bookings, services, and arrangements made through MA AJAB TOURS AND SAFARIS ("we", "us", "our"), a registered travel agency based in Watamu, Kenya. By making a booking or inquiry, you agree to these terms in full.

1. Bookings and Confirmation

A booking is confirmed once you have received a written confirmation email from us and the required deposit has been received. We reserve the right to decline any booking at our discretion prior to confirmation.

  • All bookings must be made directly with MA AJAB TOURS AND SAFARIS via our website, email, or phone.
  • The lead traveller must be at least 18 years of age at the time of booking.
  • You are responsible for ensuring all traveller details provided are accurate.

2. Pricing and Payment

  • All prices are quoted in Kenya Shillings (KES) or US Dollars (USD) as stated and are subject to change without notice until a booking is confirmed.
  • A deposit of 30% of the total booking value is required to confirm your safari or excursion.
  • The remaining balance is due no later than 14 days before the departure date.
  • Bookings made within 14 days of departure require full payment at the time of booking.
  • Accepted payment methods: M-Pesa, bank transfer, and cash. Credit/debit card payments may be subject to a processing fee.

3. Cancellations and Refunds

Cancellations must be communicated to us in writing (email to info@maajabtoursandsafaris.com). The following cancellation fees apply:

  • More than 30 days before departure: Full deposit forfeited; remainder refunded
  • 15 – 30 days before departure: 50% of total booking value forfeited
  • 7 – 14 days before departure: 75% of total booking value forfeited
  • Less than 7 days before departure: No refund

Refunds, where applicable, will be processed within 14 business days of cancellation confirmation.

4. Amendments

We will make every effort to accommodate amendment requests (date changes, itinerary adjustments). Amendment requests must be submitted in writing. Amendments are subject to availability and may incur additional costs. Significant changes to an itinerary within 7 days of departure may be treated as a cancellation.

5. Our Responsibilities

MA AJAB TOURS AND SAFARIS is responsible for arranging the services described in your confirmed itinerary. We act as a principal for services we provide directly and as an agent for third-party services (lodges, airlines, etc.).

We are not liable for:

  • Events beyond our reasonable control (force majeure), including weather, natural disasters, strikes, or government actions
  • Acts or omissions of third-party service providers
  • Personal injury, illness, loss, or damage not caused by our negligence

6. Your Responsibilities

  • You are responsible for obtaining a valid passport, visa, travel insurance, and any required vaccinations.
  • Travel insurance covering medical emergencies, trip cancellation, and loss of belongings is strongly recommended.
  • You must follow the instructions and guidance of your safari guide at all times for safety.
  • MA AJAB TOURS AND SAFARIS reserves the right to exclude any traveller whose behaviour poses a risk to others, without refund.

7. Safari Safety

Wildlife safaris involve inherent risks. While we take every precaution and employ experienced guides, you acknowledge that wildlife encounters are unpredictable. You agree to follow all safety instructions and enter game parks at your own risk.

8. Photography and Media

We may photograph or film activities for promotional purposes. By booking with us, you consent to your likeness being used in our marketing materials unless you notify us in writing otherwise.

9. Complaints

Any complaints should be raised with your guide or our team immediately so we can resolve them during your trip. Post-trip complaints must be submitted in writing within 28 days of return. We will respond within 14 business days.

10. Governing Law

These Terms & Conditions are governed by the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the Kenyan courts.
